Validity of the GTC

(1) These General Terms and Conditions shall apply to contracts for the rental of vacation apartments for accommodation as well as all other services and deliveries provided by Villa Marval for the Guest. The services of Villa Marval shall be provided exclusively on the basis of these General Terms and Conditions.

(2) The subletting or re-letting of the rented vacation apartment as well as its use for purposes other than residential purposes shall require our prior written consent.

(3) The guest’s terms and conditions shall only apply if these have been agreed in advance. Deviations from these terms and conditions are only effective if we have expressly confirmed this in writing.

§ 1 Definitions

a) The term “Villa Marval”, “we”, “us” or “our” refers to Villa Marval.

b) The term “Villa Marval” refers to our website [www.villamarval.com].

c) The term “Services” refers to all services provided by Villa Marval from time to time, including but not limited to receiving booking information through our booking and payment system, managing reservations and payments and responding to customer inquiries through our reservation system and managing content on third party channels through our Channel Manager.

d) The term “customer” refers to either: a) the individual registering for a customer account in their own name; or b) the organization with which the individual registers for a customer account on behalf of an organization.

e) The term “Customer Account” refers to the account that the Customer creates on www.villamarval.com in order to access and use the Services.

f) The term “Property” refers to any form of accommodation, building, houseboat, apartment, room, apartment block, house or other dwelling or rental space displayed by the Customer or a third party channel and offered for rent through the Services.

g) The term “Content” means text, graphics, images, music, software, audio, video, information or any other form of data.

h) The term “Customer Content” refers to content provided by the Customer in the course of using the Services, including but not limited to other information.

§ 2 Booking/booking confirmation

All booking inquiries must be made via our website (www.villamarval.com), by email [info@villamarval.com] or by telephone to 004369010027964. All requests made via any other method such as Instagram will not be considered.

If we can offer you the vacation home in your desired period, we will send you a written confirmation and the invoice by e-mail or by post. Upon receipt of the booking confirmation and after payment of the deposit (see § 3 Terms of payment), your booking is legally binding.

§ 3 Terms of payment

Your booking becomes valid upon receipt of the deposit. The deposit of 50% of the rental contract is due for payment within 7 days of receipt of the booking documents. Once the deposit has been paid, payment of the remaining amount is due 30 days before departure. If the payment deadlines are not met, Villa MarVal may withdraw from the contract. Non-payment shall be deemed as withdrawal and shall entitle the customer to re-let the property.

Additional costs for water, parking space, waste and energy costs will not be charged, except in the case of excessive consumption.

§ 4 Arrival and departure

On the day of arrival, the apartment is available from 15:00. For arrivals after 22:00, the guest must pay a surcharge of 20 euros. The guest will receive information about the handover of keys 7 days before arrival by telephone or e-mail. Claims for damages cannot be asserted if the vacation home cannot be occupied punctually at 15:00.

On the day of departure, the vacation villa must be vacated by 10:00 a.m. at the latest. If the guest wishes to leave late, this must be agreed with us in advance. A late departure without prior agreement will be charged with an additional day’s rent.

If the guest does not show up by 22:00 on the day of arrival, the contract shall be deemed terminated after a period of 48 hours without notification to Villa MarVal. Villa MarVal or our representative may then freely dispose of the property. A (pro rata) refund of the rent due to early departure will not be made.

Villa MarVal must be left swept clean on the day of departure. The dishes, glasses, etc. must be cleaned and put away, the trash cans emptied and the refrigerator emptied. If the Villa MarVal is not left as desired, you may be charged for this.

§ 5 Holiday home

Villa MarVal is handed over by us in an orderly and clean condition with a complete inventory. Should you notice any defects during your stay, the guest is obliged to inform Villa MarVal immediately. The guest is liable for any damage caused by him to the rental property, the inventory, e.g. broken dishes, damage to the floor or furniture. This also includes the cost of lost keys.

The inventory is to be treated with care and is only intended to remain in the vacation home. Moving furnishings, in particular beds, is prohibited. The guest is also liable for the fault of fellow travelers. Damage caused by force majeure is excluded from this. In the event of use of Villa MarVal in breach of the contract, such as subletting, over-occupancy, disturbance of the peace of the house, etc., the contract may be terminated without notice and the guest must therefore leave Villa MarVal. The rent already paid shall remain with Villa MarVal.

§ 6 Pets

The accommodation of pets of any kind is only permitted at Villa MarVal with the prior written consent of the provider. A reasonable surcharge of €10 to €20 will be charged for the accommodation of pets. An additional fee of €80 per stay will be charged for the accommodation of dogs.

Pet owners are obliged to ensure that their pets do not cause any damage to the property or the inventory. Should a pet cause damage, the owner is liable for the costs incurred and this damage will be charged to the guest.

It is also forbidden for pets to leave any droppings anywhere on the property. We ask all pet owners to ensure that their pets take care of their needs outside Villa MarVal.

To ensure cleanliness and hygiene, sofas in particular must be covered with suitable blankets or towels. It is strictly forbidden for pets to sleep in the beds. This measure serves to protect other guests from possible allergies and to maintain the cleanliness of the bedding.

If pets are accommodated without the prior consent of the provider, the provider reserves the right to charge a cleaning fee of up to 300 euros.

§ 7 Stay

Villa MarVal may only be used by the persons listed in the booking. If the apartment is used by more persons than agreed, a separate fee of 50 euros per person per night must be paid. In this case, Villa MarVal also has the right to terminate the contract without notice.

Subletting and transfer of the villa to third parties is not permitted. The guest agrees to the general terms and conditions and the house rules of Villa MarVal. The declaration of consent is made with the payment.

In the event of violations of the General Terms and Conditions or the house rules, Villa MarVal shall be entitled to terminate the tenancy immediately and without notice. There is no legal claim to repayment of the rent or compensation.

The fee for the final cleaning is 180€.

§ 8 Cancellation

In the event of cancellation, the guest is obliged to pay part of the agreed price as compensation. Cancellation must be made in writing. The amount of compensation depends on the time until the day of arrival and is calculated as follows

  • up to 30 days before the day of arrival 50% of the agreed price
  • from the 29th day until the day of arrival: 100 % of the agreed price.

If it is possible to find another guest at the agreed rental price for the same period, the cancellation fee will be waived after consultation with the canceling guest. In this case, only a processing fee of 200 euros is payable.

§ 9 Cancellation by the landlord

In the event of cancellation on our part, as a result of force majeure or other unforeseeable circumstances (such as accident or illness of the host) as well as other circumstances for which we are not responsible and which make fulfillment impossible, liability is limited to the reimbursement of costs. In the event of justified withdrawal, the customer shall not be entitled to compensation – no liability shall be assumed for travel and hotel costs.

Cancellation by Villa MarVal may take place after the start of the rental period without notice.

§ 10 Liability of the landlord

Villa MarVal is liable for the proper provision of the rental property within the scope of its duty of care. Liability for any failures or disruptions in the water or electricity supply, as well as events and consequences due to force majeure, are hereby excluded.

§ 11 Permission to use Internet access via WiFi

Villa MarVal maintains internet access via WiFi in its vacation home. The tenant shall allow the guest to share use of the WiFi Internet access for the duration of their stay in the vacation home. The tenant does not have the right to allow third parties to use the WiFi.

Villa Marval does not guarantee the actual availability, suitability or reliability of the Internet access for any purpose. It shall be entitled at any time to permit other co-users to operate the WLAN in whole, in part or temporarily and to restrict or exclude the Tenant’s access in whole, in part or temporarily if the connection is or was used in an unlawful manner, insofar as Villa Marval must fear a claim for this reason and cannot prevent this with customary and reasonable effort within a reasonable period of time. In particular, Villa Marval reserves the right to block access to certain pages or services via the WLAN (e.g. pages glorifying violence, pornographic or fee-based pages) at its reasonable discretion and at any time.

§ 11.1 Access data

Use of the WLAN is secured by means of access protection. The access data (login and password) may not be passed on to third parties under any circumstances. If the guest wishes to grant third parties access to the Internet via the WLAN, this is subject to our prior written consent and the third party’s acceptance of the provisions of this user agreement, documented by signature and full identification. The guest undertakes to keep his/her access data secret. Villa Marval has the right to change access codes at any time.

§ 11.2 Dangers of WLAN use, limitation of liability

The guest is informed that the WLAN only enables access to the Internet, virus protection and firewall are not available. The data traffic generated using the WLAN is unencrypted. The data can therefore possibly be viewed by third parties. Villa Marval expressly points out that there is a risk that malware (e.g. viruses, Trojans, worms, etc.) can get onto the end device when using the WLAN. Use of the WLAN is at the guest’s own risk. We accept no liability for damage to the tenant’s digital media caused by the use of Internet access, unless the damage was caused by us and/or our vicarious agents intentionally or through gross negligence.

§ 12 House rules, general rights and obligations

(1) The guest is obliged to comply with the house rules. From 22:00 to 07:00 the night’s rest applies. To avoid disturbance, TV and audio equipment must be set to room volume.

(2) For the duration of the rental of the vacation home, the guest is obliged to keep windows and doors closed when leaving the villa.

(3) There is a general smoking ban in the villa. In the event of non-compliance, you may be charged a cleaning fee of up to 200 euros. Smoking is only permitted on balconies and terraces.

(4) Our own parking lot offers 4 parking spaces. Please make sure that no vehicles obstruct the road.

(5) The use of the children’s playground is permitted for children up to 12 years and is at your own risk. Parents are liable for their children.

(6) The installation and/or attachment of materials for decoration or similar is not permitted in the Villa MarVal. The guest is solely liable for any decorations or the like that are nevertheless installed and/or attached. The guest is also obliged to compensate for any damage caused by the installation or attachment of decorations or similar.

(7) Villa MarVal shall have the right to access the vacation home at any time, in particular in the event of imminent danger. When exercising the right of access, due consideration must be given to the guest’s legitimate interests. We shall inform the guest in advance of the exercise of the right of access, unless this is unreasonable or impossible in the circumstances of the individual case.

§ 13 Place of jurisdiction

Any disputes arising from the contractual relationship shall be subject to the jurisdiction of the Vienna District Court.
